Girls' Day Out

Like the rest of my kakis I was too pooped to blog immediately about the outing.

(In fact I woke up at 3pm today! New record woot!)

But then again I am forgiven since post-KL sickness is an officially recognized disease.

Plus walking in kik-kok soos for... *counts* TWELVE AND A HALF hours really kills.

But here I am! Alive and well, after Kgung2's birthday dinner (of which I have no pictures of because, well, it was rainy and crowded and pretty much uneventful).

Nah, kidding. Here's one of Yenn2. :)

And so my rant begins.

At 8.30 it was announced over the PA that the KTM was gonna be delayed (ooh surprise surprise) so I stood about for nearly half an hour in said kik-kok soos, and I thought I saw a couple of juniors (Caroline? Esther?) but I wasn't sure... But if it was them I sure felt a little... Okay lah I was worried as heck, these small babies come out on their own, with zero parental supervision, all girls summore, with one skinny little China boy with them, if they kanna snatch-thieved then how, HOW, you tell me?! Okay I am aware that I am but a year, if not a mere couple of months older, but that doesn't mean I shouldn't be concerned! I mean, kanna molested no fun one you know? Unless the fella resembles Haru or something. If it were up to me they would have to be chaperoned everywhere they go until they turn 33. Hmph.

Anyhoo. I reached MV and the entrance was under upgrade work, so the floor was uneven... And well, I tripped. But I assure you that I tripped with STYLE.

Then we met up at Mickey D's (why does my life constantly revolve around McD's? I should be given customer loyalty points or something) and had those 1-buck sundae cones, and after seeing the size of them I'm convinced the McD's in Petaling is under strict instruction to rip us and the farangs off as much as possible. *grumble grumble*

Anyhoo, we were in the midst of blowing some wind about (no, it wasn't a farting contest... I just feel that the "G" word is a bit... dirty and sin-ish. Calling it by another name makes me feel better. ^^) when some guy (Adrian, I think) asked us to donate like 10 bucks for 4 days' worth of care for a spastic kid... Basically after his fastforwarded memorised little speech I just told him I wasn't interested (I had to jadi bad guy because the girls were too polite) and he said thanks and turned away... my sundae didn't taste quite as yummy as it was before I decided to neglect my social responsibility to contribute to the care of some poor, suffering child.

Bah, humbug! (..and the Grinch's heart shrank two sizes that day.)

Anyhoo the plan was to have a movie marathon, which totalled up to RM24, *coughbleedingfartingexpensivecough* and the first one was Shinjuku Incident. Quadruple date with Dannyboy yay!

Unfortunately.

I was pretty much disappointed, because it was the biggest Jackie Chan vanity project I have ever had the misfortune to pay 12 bucks for; beyond the one 3-minute scene where Dannyboy was bathing, we didn't get to see a lot of him in his nude, sexyfine glory. In fact, there were more shots of that bathroom scene with Uncle Jackie nude instead. Nakedsixtyyearoldman *barf* Protege was so much better. XP

I know the director was some dude named Derek Yee, but seeing as to Uncle Jack's the producer, I'll bet my balls he had quite a substantial say in it.

Evidence: Jackie Chan plays some immigrant from the mainland named Tietou (Steelhead, which would have been a very cool character name in like what, the 80s?) who has some hot chick girlfriend named Xiu Xiu, who, despite being I dunno, three decades younger, picks him as her lover because the whole of China got no one more attractive and irresistable than Jackie Chan.

Anyhoo the story is that she goes to Japan or something so this lovesick 60-year-old puppy goes there to look for her.

He then meets a very cute afro'd Daniel Wu, and um, blahblahblah we discover that XX is married to this yakuza guy named Eguchi (a seriously smokin' 40-something Kato Masaya) and um, somehow he earns his trust and he gets to control this area called Shinjuku.

Vanity enough for you?

Oh you don't know the half of it.

He makes sure that the ultra-adorable Jie (Dannyboy) is tortured and scarred beyond recognition using unreasonably violent and gory means. "Tai leyy sei ah, kgom leng zai!" seemed to be brewing in his mind when they decided that Jie should have his faced carved a la Naruto and have his right hand teppanyaki-ed in a chestnut roaster and finally having it dismembered using the metal stirrer. (ideas for your novel, Alana?)

Jie, emotionally tormented, suddenly decides to turn ultra-mega-super-mutatedly lala, wearing black lipstick, foundation 113 shades too light, disastrously-applied black eyeshadow and a silver puffy wig, with the single, admirable life ambition of snorting coke. And then... He dies.

Seriously. After much whining, whimpering and soiling his pants. *sigh* Danny-baby, choose more self-promoting roles can? This is about the most unattractive character you've played yet *twitch*

Eguchi's fate is none the better, as he is quickly eliminated with a couple of gunshots.

Seriously, we couldn't enjoy the movie for Danny (unbelievable, but true) or Kato, and there were no awesome flashy kung-fu fight scenes, just bats and guns and parangs. -.-"

I hereby appeal to you: save your twelve bucks and watch something else, like He's Just Not That Into You or something. Anything.

The next movie was Fast and Furious (subtitled as Pantas dan Garang. For real.), and we shamelessly smuggled our lunch in, given the narrow time frame we had in between the two. I guess we were pretty pooped so somehow I got the impression that it wasn't as engaging. Plus they killed Michy Rodriguez about ten minutes into the show. What lah, I liked her man. Also Vin Diesel had smaller, floppier-looking muscles compared to his Riddick days and had over the years acquired Bruce Willis-y smile lines. Paul Walker was also scruffier, but them eyes were still as swoonworthy. Heck, if more cops looked like him I'd kanna arrested every day. *wiggles eyebrows* :D

After it was all over we traipsed over to F.O.S to send Cathy off, where she tried to pimp her brother off on us, but we were nice and well-behaved and very ethical, so he escaped unscathed.

After my short modelling career with Victoria's Secret, Sylvea headed home and I accompanied Sue Peng to get dinner and saw this!

Ranma fishcakes! Who knew they actually existed!
(the characters translate as "fish biscuit" methinks)

Then Mom and Dad and Pupu arrived, and they stayed even longer, despite my feets killing me. Oh wait, that's not true. I went back to F.O.S and got some new tanks (four for RM32 can you believe it?!) before reaching home at around what, 9?

Yep you will not believe the size of my blisters. Sneakers are my friends. Sneakers are my friends. Oh yes sneakers are my friends...

But overall it was pretty fun, haven't had an outing in ages. (socially dead, you see) Next trip mustmustMUST involve more jackarsery! ;D

The Rule in Blahlands and Blahtcher

So.

Because TAI JIN LING attended to Cheng Beng-ly duties refused to wake up for Sara's class last Friday, she missed out on the rule in Rylands v Fletcher class.

Hence, I have been called forth to demonstrate my note-taking prowess.
(which sadly does not have anything to do with my ability to retain said information at all)

I am still considering that kindy teaching job! *foolish mortal*

So make me proud, Ai Ren! ^^

Let us begin.

***

TAKE NOTE! (Sara's fave phrase lol)
  • The distinction between strict liability and fault liability
  • The elements that had made the distinction between strict liability and fault liability
  • Fault liability can only occur when there is a foreseeability of harm. Whereas strict liability can be imposed even if the defendants did not foresee the harm.
fault liability - carelessness on the defendant's part

In the tort of nuisance, the requirement such as the foreseeability of harm, the conduct of the defendants had suggested that this type of tort would be a fault liability tort.

Generally, any form of harm suffered by the plaintiff which falls within the ambit explained in
Hunter v Canary Wharf
an action can be taken under nuisance.

However, in the case of
Rylands v Fletcher [1865]
the Court, in determining the liability of the defendant, was not able to fulfill the requirement of fault liability as the Court could not discover the fault element on the facts. Hence, Justice Blackburn in establishing a liability against the defendant, which was affirmed in the House of Lords, created an extension to the tort of nuisance. This was eventually regarded as one of strict liability tort.

So the rule in R v F = extension of tort of nuisance; is a strict liability tort. Geddit.

When approaching a question, start with nuisance. Alternatively, refer to Rylands.

  • Facts of Rylands v Fletcher
The defendant employed independent constructor to construct a reservoir. Whilst digging, the contractor found it to be a disused mine, but failed to seal it properly. Later, the water flooded through the mine shafts into the plaintiff's property. In establishing the liability and affirmed by the HoL, Blackburn J laid down the following rule: (refer to Chapterpack, pg 1)

What Blackburn says in Rylands is veryvery important btw... 'Cause well, it is the bleeding rule in R v F.

Requirements in R v F
  • Defendant brought something onto his land (his land his land his land! Nobody else's land)
  • Non-natural use of the land
  • The thing was likely to do mischief if it escaped
  • The thing did escape, and caused damage.

1.) Escape

Definition of 'escape'
Read v Lyons (something about an ammunitions factory explosion)
Viscount Simon:
'Escape' is defined as escape from a place where the defendant has occupation or control over land to a place which is outside his occupation or control.

CHUP!

Sounds like Occupiers' Liability? Confused? Let's take a look.

R v F
occupational control
-harm must happen OUTSIDE defendant's land (of course, this applies to nuisance and negligence as well)

c/f

OLA
sufficient control
-harm occurs WITHIN defendant's premises

In 1994, the HoL, especially based on the decisions of Lord Goffe, came up with an additional requirement based on R v F, in the case of
Cambridge Water Works v Eastern Counties Leather [1994]
According to Lord Goffe, since the harm was not foreseeable, the liability could not be assured.

CHUP!

WTFish? Like, didn't you just say that R v F is supposed to be strict liability? What, does that mean that foreseeability's back in town?

(Now, I am absurdly proud of my note-taking capabilities, and I assure you that I didn't get that part wrong. :P)

Let us take a look at foreseeability.

i.) in R v F
-foreseeability that the substance can escape/not

ii.) of damage
-not required in R v F

Hence, R v F is still regarded as strict liability tort. :)

Transco plc v Stockport Metropolitan Borough Council
clarified the requirements in R v F, which includes Lord Goffe's requirement of foreseeability.

So the requirements in R v F today now look like this:
  • Defendant brought something onto his land (his land his land his land! Nobody else's land)
  • Non-natural use of the land
  • The thing was likely to do mischief if it escaped
  • The thing did escape, and caused damage.
+
  • Foreseeability of the escape of the substance (Lord Goffe, Cambridge Water Works, 1994)

2.) Non-natural use of the land
Things grown or occurring naturally in the land
c/f defendant bringing something onto his land

Something can be regarded as non-natural user of the land in one case but not necessarily in another i.e. it's pretty subjective (Lord Porter, Read v Lyons, Chapterpack pg 3)

Re: Transco plc
According to Lord Hoffman, a 'non-natural user' means that the defendant's use created an increased risk

Ellison v Minister of Defence [1997]
-non-natural user of the land
In this case, the court stated that the flood occurred as a result of rainwater; it is not a non-natural user of the land.

3.) Damage
If there is no damage, because the plaintiff took steps to prevent it, then he can claim for the amount used to prevent the damage that would have happened.

The damage here refers to the land or to chattels.
Halsey v Esso Petroleum [1961]

The courts are generally not in favour of allowing a claim for pure economic loss.
Weller v Foot and Mouth Disease Research Institute [1966]

In the case of
Hunter v Canary Wharf
Lord Hoffman stated that damages for personal injury per se would not be recoverable either under nuisance or R v F.

  • Defences
Tennent v Earl of Glasgow (re: Act of God)
-Lord Westbury:
"An act of God is an event which no human foresight can provide against, and of which human prudence is not bound to recognise the possibility."

TAKE NOTE:
  • Rylands v Fletcher, Blackburn's rule (CP pg 1)
  • Transco plc (CP pg 1)
  • British Celanese (CP pg 2)
  • Weller v Foot and Mouth (CP pg 2)
  • Rickards v Lothian (CP pg 3)
  • Lord Porter in Read v Lyons (CP pg 3)
  • Rainham Chemical v Belvedere Fish Guano (CP pg 3)
  • Noble v Harrison c/f Cowhurst v Amersham (CP pg 3) -it would be more practical to pursue under Nuisance.
  • Consent of the plaintiff and Common benefit (CP pg 4) -are specific defences under R v F -can be regarded as overlapping as CB is usually only any good only if CotP is satisfied first
  • Perry v Kendricks c/f Hale v Jennings (CP pg 4)
  • Nichols v Marsland c/f Greenock Corp. (CP pg 4) -in Nichols exceptionally heavy rain can be regarded as a good defence but Greenock disagrees -it is a direct contrast; neither was overruled, so dua-dua pun boleh pakai
  • Default of the plaintiff (CP pg 4) -if the plaintiff is aware but does nothing to contain the problem
  • Statutory authority (CP pg 5) -good defence.
Okay, done! My nerdiest post ever. I hope there are no mistakes; there shouldn't be because I was a reasonably good little nerd that day. ^^

It's Over.

It's finished!

The Last Airbender has ended.
(Shut up about it having ended last year itself; I just watched it lah okay.)

See the original here.
SO. HAPPY. :D

Well I love it that Ty Lee went and joined her new BFFs the Kyoshi warriors (pretty make-up!) and all, but I'm kinda sad for Azula. Kesian-ted betul.

And I'm pretty mad that Mai didn't die!! WTF, Azula should have totally lightning-ed the emo outta her. And Aang should have died a tragic hero. (Yeah I already know how it ends I wiki-ed it but you know, Zutara fan. In denial and all.) Ups the dramatic effect mah.

See the original here.
And why oh WHY didn't THIS happen?!! You know it was meant to be! T__T

And Mako!!! Why did he have to die! The new Iroh tried so hard to replicate everything endearing about the old Iroh's voice it was annoying. XP

And another thing...!

OMG shut up can't you be happy and just shut up. *rolls eyes*

Sigh. Alright. It was wonderfulllll. =3

I officially love Mike and Bryan, despite the ultra-gross Kataang and Maiko ending. Eww.

Because Mike is a Zutarian, and that counts for something. :D
(Yes I know he is I am omniscient you know.)

Thank you Mike and Bryan for the most wonderful series I have ever obsessed about, second only to La Usurpadora!

See the original here.
Beautiful. *tears up*

See the original here.
And megathanks for giving us Sifu Hotman. *megadrool*

...

"Baby, you're my forever-girl!" OMGGG XD XD *dies*

PS: My palms are smarting from being cheesegrated by tombstones. Why in the name of Datuk Shah Rukh Khan did we have to bury our ancestors ON TOP OF A HILL. (on which I humiliated myself both going up and coming down. I swear you've never heard so much noise at a cemetery.)

Oh and it seems I've found another clan to be related to. Hello Lees. :D

PPS: I'm in for a world of hurt tomorrow. :S
But I want it. I do.

EDIT: Holy scheisse I forgot to include the links to the originals! Can't believe I was so rip-offy. Repetitive Is My Middle Name

I think I must be annoying the crap outta people with the whole I-want-a-job thing.

I talk about it incessantly, (like now) and even in my sleep.

But bear with me, for I am truly very excited. :D

Anyhoo, guess what! Val told me that hospitals apparently have FRONT DESKS!

Ain't that amazing? I always thought only hotels had such things!

Well I guess it could be an option...

Man: OMG help me! Emergency! My arm just got ripped off 'cause my car smashed into an oil tanker and exploded OMG it hurts I need a doctor quick somebody help me!!!!

Me: *yawn* Sir, that attitude is not going to speed things up any bit.

Man: Are you crazy, woman?! *waves severed arm* Didn't you hear what I just said?! I'm like, totally bleeding to death!!!

Me: Yerr. Sir, you're making a mess with your blood dripping everywhere. Don't swing it around some more! Dang. Ya got some on my folder. Great. *wipe wipe* Take a number, and wait in line like everyone else.*picks at nails*

Man: But...

Me: Sir. I have to deal with at least twenty people a day who think they can just waltz right in and see the doctors on a whim. Why do you think people make appointments?! Geez! Hey. It's late, and I'm tired. Save me the trouble and don't be the twenty-first today.

Man: So... weak... I can't... see...

Me: Don't be a drama-mama either.

Man: Can't feel... my legs... so... cold...

Me: Look, I've had just about enough of you! Take a number, and SIT DOWN!

Man: *collapses*

Me: Now THAT'S more like it. Eh Val, going to cafeteria is it? Get me Milo can? Ah, hot one. Make it kurang manis hor! *flips open mag* Gawd I hate this place.

...and that's why Pantai Medical Bangsar should totally hire me. Look how professionally I handled the situation! Just like ultra-experienced hospital admin staff!

Yep. I think I'm up for this job.

Think I should send this in as part of my resume? ;P
Oh please lah Jesus there must be some job out there that I can do... :S
